Graphisoft and Diehl Graphsoft, Inc. Reach Trademark Settlement

Graphisoft®, developers of Archicad® CAD software for Macintosh
and Windows operating systems, and Diehl Graphsoft, Inc. signed an out-of-court
settlement on August 30, 1996, preventing Diehl Graphsoft from using the
name, «Graphsoft,» alone without identifying itself as Diehl
Graphsoft, Inc. in any «letterhead, business cards, directory listings,
marketing materials, brochures, newsletters and content of world wide web
pages.» Graphisoft, the owner of the registered trademark of Graphisoft®
in the U.S. and several other countries, grants Diehl Graphsoft Inc. the
worldwide right to use its full corporate name on any media.
The use of Diehl Graphsoft’s name is required to change on any new marketing
material by February 28, 1997. They must also register to change the company’s
world wide web domain name by September 30, 1996 and all marketing material
must reflect that change by October 31, 1996. Within two weeks of the settlement
Diehl Graphsoft agreed to inform in writing «all of its business partners,
including, but not limited to, its dealers, distributors, and resellers
regarding the terms of this agreement and the restrictions on the use of
the company name.»
«Maintaining a clear distinction between our companies is fair
to the customer who might think that the same company was manufacturing
both Archicad and Diehl Graphsoft’s software, MiniCad. We are pleased that
this unfortunate dispute of several years has finally been settled.»
says Gábor Bojár, president of Graphisoft. «We have
always agreed that our respective products (MiniCAD from Diehl Graphsoft
and Archicad® from Graphisoft®) address different markets and are
not competitors. We have also always agreed that both companies should
focus on the market rather than on the court room. Now, finally agree that
our customers and prospective customers should not be confused about the
origin of our products as well.»
